Liability Disclaimer & Waiver

Effective Date: October 29, 2026

This Liability Disclaimer & Waiver applies to all products and services from Atlas Gun Services LLC ("Atlas Gun Services," "we," "us"), 13380 Telge Rd Ste 805, Cypress, TX 77429. It works together with our Terms of Sale and Returns & Refunds Policy. By buying from us, transferring a firearm through us, or leaving a firearm with us for service, you agree to it.

Firearms are dangerous

Firearms, parts and ammunition are inherently dangerous. You take on all risk for:

  • handling, storing, transporting and using them safely
  • complying with federal, state and local law

Atlas Gun Services isn't liable for misuse, negligence, accidents or unlawful use of any firearm, part or ammunition that we sell, transfer or service.

Gunsmithing, modifications and installation

  • Your choice, your risk. You request modifications, upgrades and installations at your own risk.
  • Warranties. Some changes may void the manufacturer's warranty.
  • What we're not responsible for. We work to professional standards, but we aren't responsible for problems caused by:
    • parts you supply
    • earlier modifications or repairs
    • normal wear
    • ammunition or reloads
    • later changes made by anyone else
  • Test before you shoot. After any work, function-test your firearm and have it inspected before live fire.
  • Workmanship problems. Tell us about a workmanship issue within 7 days of pickup. If we verify it, we'll correct it.

Cerakote and refinishing

  • Color matching, texture and finish can vary from samples, photos and other parts.
  • Cerakote adds a thin layer of thickness, which can affect fit and tolerances.
  • Report finish problems from our workmanship within 7 days of pickup.
  • Normal wear, holster wear and exposure to chemicals or solvents are not covered.

Gun cleaning

  • We inspect firearms when we receive them.
  • We aren't responsible for existing damage, or for worn or broken parts found during cleaning.
  • If we find a problem, we'll let you know.

Firearms left in our care

  • We store firearms in our care securely.
  • We aren't liable for loss or damage from events beyond our reasonable control.
  • If a firearm isn't picked up within 30 days after we notify you that the work is done:
    • we may contact you about it, and
    • we'll handle it as federal law and federal recordkeeping rules require.

NFA items and transfers

For suppressors and other National Firearms Act items, you're responsible for:

  • being legally eligible to own the item
  • following the laws where you live and where you'll possess or use it

NFA items are released only after ATF approves the transfer.

Limitation of liability

  • To the fullest extent Texas law allows, our total liability for any claim related to a product or service is limited to what you paid for that specific product or service.
  • We aren't liable for indirect, incidental, special or consequential damages.
  • Nothing in this statement limits liability that the law doesn't allow us to limit.

Indemnification

You agree to defend, indemnify and hold harmless Atlas Gun Services LLC and its owners and employees from claims, losses and expenses, including reasonable attorneys' fees, that arise from:

  • your misuse or unlawful use of any firearm, part or ammunition, or
  • your breach of this statement.

Governing law and venue

This statement is governed by the laws of the State of Texas. Any dispute will be brought in the state or federal courts in Harris County, Texas.
